Public Participant Terms

Effective May 29, 2026

These terms apply when you create a Livy account or use Livy to participate in a public agency's meetings or workflows. When you use Livy, you also agree to our Privacy Policy.

Livy provides software for public agencies. Livy does not replace an agency's official meeting notices, rules, or participation instructions. If something in Livy conflicts with the agency's official materials, the agency's materials control.

What Livy does

Livy provides tools that help public agencies run meetings, share materials, collect input from the public, and keep records. The agency decides how it uses those tools.

In particular, the agency, not Livy, decides:

Specific features and their behavior may evolve. Current behavior is described in the product and in materials your agency provides.

Attending public meetings

A Livy account is not required to attend or observe a public meeting. Livy may be used for optional online workflows. Your rights to attend, observe, and participate in public meetings, and any deadlines or accommodations, are governed by the agency's notices, rules, and applicable law. Livy does not create, limit, or replace those rights.

Your account

Provide accurate account information, keep your credentials secure, and let us know if you believe your account has been compromised. You are responsible for activity through your account unless you promptly report unauthorized access.

Submitting content and participating

If you submit content or use public-participation tools an agency makes available through Livy, your submission and related information may be shared with the agency. This can include your name, contact details, submission text, related metadata, and timestamps.

Anything you submit may be published, retained, disclosed, or treated as a public record or official meeting material by the agency.

Where an agency offers online tools to organize speakers, your use of those tools does not guarantee that you will be called, recognized, or able to participate before an item or meeting ends. The agency, chair, clerk, or other meeting administrator controls recognition and meeting procedure.

Livy is not responsible for outages, settings, moderation, captioning, recordings, or access controls of third-party services the agency uses to host, stream, moderate, or capture meetings.

Sensitive information

Do not submit Social Security numbers, financial-account numbers, passwords, detailed medical information, or other highly sensitive personal information unless the agency specifically asks for it and you believe it is necessary for the agency's process.

Rules for using Livy

You may not use Livy to:

Livy may remove content, restrict access, or suspend accounts to protect security, service availability, legal compliance, or agency workflows.

Livy does not restrict content merely because it criticizes a public agency, official, policy, program, service, or action.

Your content

You keep whatever rights you have in content you submit.

You grant Livy and the participating agency a nonexclusive, worldwide, royalty-free license to host, process, store, transmit, format, display, publish, retain, and disclose your content as needed to provide Livy, operate agency workflows, comply with law, and maintain public records or meeting materials.

Closing your account

You may stop using Livy at any time. To close your account, contact Livy support at support@livygov.com.

Closing your account will not delete content, metadata, or other materials already submitted to, controlled by, published by, retained by, or disclosed by a public agency.

Children and minors

Livy is not directed to children under 13. Minors may use Livy only where allowed by the participating agency and where any legally required parent, guardian, school, or agency permission has been obtained. Agencies are responsible for determining whether participation by minors requires additional consent, notice, or safeguards.

Disclaimers

Public-facing Livy features are provided "as is" and "as available."

Livy does not guarantee uninterrupted access, successful submission, preservation of a submission, receipt by a deadline, an opportunity to speak, publication, agency consideration, accuracy of agency materials, or the legal sufficiency of any meeting or public-participation process.

Livy does not provide legal, financial, compliance, or professional advice.

Limitation of liability

To the fullest extent allowed by law, Livy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, lost opportunities, reputational harm, or emotional distress arising from your use of Livy.

To the fullest extent allowed by law, Livy's total aggregate liability to you for all claims arising out of or relating to these terms or Livy's public-facing features will not exceed $20.

Changes to these terms

Livy may update these terms by posting an updated version. Material changes apply from the effective date stated with the updated terms.

Governing law

California law governs these terms, without regard to conflict-of-law rules, unless applicable law requires otherwise. Disputes relating to these terms may be brought in the state or federal courts located in California, except where small-claims court or another forum is required by applicable law.
